人工智能的宪法挑战和宪法弹性回应

[摘要]伴随人工智能的发展，宪法的价值体系面临人权消解、法治系统的权力失衡和民主新可能的问题。如何应对这些挑战将是宪法的时代责任。结合人工智能意识产生前后的能力差异，以及社会影响强弱，宪法的战略回应可归类为短期策略和长期策略。在弱人工智能时代，短期策略是宪法解释，主要任务是加强科技宪法的研究。在强人工智能、超人工智能时代，长期策略是修改宪法、专门人工智能立宪。在回应模式构建中，应将弹性理论与宪法应对联系起来。宪法弹性的构建，是主动应对人工智能挑战的战略，既能为应对人工智能的系统性宪法价值破坏做好积极准备，又能为应对人工智能的破坏性而产生宪法价值新形式提供机会。

Abstract：Withthedevelopmentofartificialintelligence，thevaluesystemoftheconstitutionfacestheproblemsofeliminationofhumanrights，theimbalanceofpowerintheruleoflawsystem，andthenewpossibilityofdemocracy.Howtomeetthesechallengeswillbetheconstitutiondutyoftheday.Inthiscontext，thestrategicresponseoftheconstitutioncanbeclassifiedintoshort-termstrategyandlong-termstrategybasedontheabilitydifferencebeforeandaftertheemergenceofartificialintelligenceconsciousnessandthestrengthofsocialinfluence.Intheeraofweakartificialintelligence，theshort-termstrategyistointerprettheconstitution，andthemaintaskistostrengthentheresearchonconstitutionofscienceandtechnology.Intheeraofstrongartificialintelligenceandsuperartificialintelligence，thelong-termstrategyistoamendtheconstitutionandmakeaconstitutionexclusivelyforartificialintelligence.Intheconstructionofresponsemodel，theresiliencetheoryshouldbelinkedwithconstitutionalresponse.Theconstructionofconstitutionalresilienceisastrategytoactivelyrespondtothechallengesofartificialintelligence.Itnotonlyactivelypreparesforthesystematicdestructionofconstitutionalvalueofartificialintelligence，butalsoprovidesopportunitiesfornewformsofartificialintelligencesdestructiveconstitutionalvalue.
