and/orBarcoConnectedServicesusedsubjecttotherelevantProductSpecificTerms.Additional

additionalterms;inwhichcasethosedifferenttermsapplyprospectivelyanddonotalterYouror
Barco’srightsrelatingtopre-updatedsoftware.
Pleasereadthisdocumentcarefullybeforeopening,downloading,installing,orusingtheBarco
Technology.IfYouacceptthesetermsonbehalfofanentity(e.g.,youremployerorcustomer),You
representandwarrantthatYouaredulyempoweredbysuchentitytoactonitsbehalf.
BYUSINGTHEBARCOTECHNOLOGY,YOUAGREETOUNCONDITIONALLYACCEPTTHEBARCO
TECHNOLOGYANDAGREETOCOMPLYWITHTHESETERMS.
1.Definitions
“Affiliate”meansanycorporationorotherentitydirectlyorindirectly,controlling,controlledbyor
undercommoncontrolwithsuchcorporationorentity.“Control”shallmean(i)theownershipor
control,directlyorindirectly,offiftypercent(50%)ormoreoftheequitycapitalorthesharesor
votingrightsinthecorporationorotherentityinquestionor(ii)thecontrolofthecompositionof
theboardofdirectorsofthecorporationorotherentityinquestion.
“Barco”meansBarcoNV(companynumber0473.191.041)withcompanyaddressat
Beneluxpark21,8500Kortrijk,Belgium,oritsdesignatedAffiliatelicensingtoyoutheproprietary
softwarewhichisthesubjectmatterofthisAgreement.
“BarcoPartner”meansaBarcoauthorizedreseller,distributor,integratororotherintermediary
authorizedbyBarcotosellBarcoTechnology
“BarcoTechnology”means,asrelevant,theBarcoSoftwareapplicationusedbyYouand/ortheBarco
