从法律属性方面考察，它虽切合了书证这一法定证据的证明形式但它又不同于书 证。而品格证据在未成年人刑事案件中的运用具有较为重要的意义，因而，它应 该要作为一种法定证据而存在，笔者认为，按照现有的刑事诉讼证据种类的分类 标准，未成年人刑事案件中品格证据的运用形式可以是品格证据调查报告。 借鉴国外的成熟做法，构建我国未成年人刑事案件中的品格证据运用规则， 从主体因素考察，可分为被告人的品格证据规则、被害人的品格证据规则和证人 的品格证据规则。主体的品格证据规则又可从两个方面进行考察，即良好品格证 据规则与不良品格证据规则。从具体运用层面讲，未成年人刑事案件中品格证据 可以运用于各个诉讼程序当中，它的运用可具体表现在审前程序如侦查、起诉中 的运用、审判程序如定罪、量刑、判决中的运用和执行程序中的运用等部分。 关键词：未成年人；品格证据；相关性；法律属性 II Abstract Character evidence is applicable to criminal proceedings, the main role is to investigate the suspect’s character, the defendants potential threat to the society personally and its degree of harm it possess. These factors can be used to determine whether the charges can be established and the type and range of penalties. Character evidence can be seen from a person’s intrinsic and extrinsic behavior, the dialectical relationship can be determined from the character of a person’s health status, his understanding, the will states, physiological and psychological developments . This set of comprehensive studies of specific behavior analysis of the perpetrator will assist in the decision of the extent of their criminal damage, which would also guide the judiciary to make the right judicial and specific decision with respect to each particular case. In the principle of comprehensive investigation, impartial administration of justice and the special c onsideration for juvenile criminal cases, the application of character evidence requires more theoretical research and practice in a significant manner.
