毕 业 论 文 题 目： 城市土地闲置法律问题研究 学 院： 法学与公共管理学院 专 业： 法 学 姓 名： 杨宇博 学 号： 151214134 指导老师： 张 强 完成时间： 2016年4月15日 城市土地闲置法律问题研究 摘 要 城市作为土地利用率较高的行政区域，根据我国现有的土地制度，政府几乎掌控了所有城市土地资源，形成了巨大的国有资源，但是这些国有资源并未全部得到应有的应用。面对这种情况，本文根据我国城市土地闲置的特点，通过对我国城市土地闲置法律发展历程的研究，采用参考文献法、实证研究法等方法，从以下四大板块进行探讨： 首先，正文部分开端，主要介绍本文的理论基础。首先对土地、城市土地、闲置和土地闲置进行法律意义上的内涵明确。然后对已有的土地闲置问题研究的基本理论进行介绍，分析其内涵和特点，以及在本文中的应用。最后，介绍其他国家有关土地闲置法律的现状，旨在给完善我国城市土地闲置法律体系借鉴。 然后，用实证研究等方法，分析了我国城市土地闲置法律的发展历程和现状，给出法律根源介绍。 其次，根据前文分析，结合理论知识和实际情况，说明我国城市土地闲置法律体系中存在土地供给机制不完善、审批流程过于繁琐、部分规定不够严谨和忽视监管等问题。 最后，从完善土地供给机制、优化土地审批程序和加大土地使用监管立法三个方面提出我国城市土地闲置法律体系优化策略。 关键词：城市土地；土地闲置；法律问题 ABSTRACT City as a higher used administrative area of land utilization is almost all controlled by government according to the existing land system in our country.However, the land resources not be made full use. In the face , this article based on the characteristics of the urban land idle, through the research of urban land idle law development course in our country, using the reference method, empirical method and other methods, discusses from the following four major parts: First of all, the body start, mainly introduces the theoretical basis of this article. First of all, the urban land, idle land and unused land clear legal connotation. And then to the existing problem of idle land research introduces the basic theory, analysis of the connotation and characteristics, and application in this article. Finally, the present situation of the other countries about the land idle law, aimed at idle legal system to perfect our country city land using for reference.
